Purpose
These Terms set out the conditions for using the GoPic app and related websites (the “Service”) provided by Good Morning Nha Trang (the “Company”), as well as the rights, obligations, and scope of responsibility of the Company and users.
Service
- GoPic is an assistive service that uses a photo captured or selected by the user to identify a business name or other information needed for a search, constructs a search query, and connects the user to external search services such as Google Search.
- Photos and related request information may be transmitted to and processed by external AI or related processing services to provide image analysis and search features. Processing by those external services may be subject to each provider’s privacy policy and terms of use.
- Location permission is optional. If the user grants permission, the Service may use location information to help provide more relevant searches. The Service remains available without location permission, except for features that require location.
Account and Free Use
- Some features may require sign-in.
- A standard account receives the first 7 uses free of charge. The method used to count and display free uses may be adjusted as reasonably necessary for operation of the Service, and the Company may restrict or correct use where an error, abuse, or abnormal access is identified.
- After all free uses have been consumed, the user may continue to use the Service by subscribing to Premium or, where applicable, within the scope of any other usage entitlement separately provided by the Company.
Premium, Payments, and Subscriptions
- Premium may be offered in 1-week, 1-month, or 1-year plans. The products actually offered, prices, currency, taxes, and renewal terms are those shown by Apple App Store or Google Play at the time of purchase.
- Purchases, automatic renewal, subscription cancellation, and refunds are governed by the policies and procedures of the Apple App Store or Google Play through which the user made the purchase.
- Deleting the GoPic app or deleting a GoPic account does not automatically cancel a store subscription. To prevent further charges, the user must cancel the subscription directly in the subscription-management screen of the relevant store.
User Obligations
Users must not infringe the rights of others or applicable law, use the Service through false or improper means, interfere with the normal operation of the Service, or misuse systems, accounts, free-use opportunities, or payment procedures.
External AI and Search Services; Results
- External services such as Gemini, ChatGPT, Meta AI, and Google Search are operated independently by their respective providers, and each provider’s terms of service, privacy policy, usage limits, and scope of support apply separately.
- External AI analysis and search results may be inaccurate, delayed, or unavailable depending on the condition of the photo, network, language, location, status of the external service, or other circumstances.
- GoPic does not guarantee the existence, accuracy, currency, completeness, or safety of any specific business, place, business name, search result, rating, or review.
Changes and Suspension of the Service
The Company may change or temporarily suspend all or part of the Service where reasonably necessary for stable operation, security, changes in law or policy, feature improvements, changes or suspension of external services, system maintenance, or similar reasons. Material changes affecting users will be announced in the manner required by applicable law.
Limitation of Liability and User Verification
- GoPic is an assistive tool for photo analysis and external search; it is not a service in which the Company creates or guarantees the content of search results or external services.
- Before making decisions involving travel, visits, reservations, purchases, payments, safety, or other important matters, users should independently verify official information from the relevant business, on-site information, and, where necessary, information from competent authorities.
- If a user finds an incorrect search result, the user may use the “Report” feature in the app’s usage history. Reports may be used to improve the Service, but the Company does not guarantee immediate correction of every report or any individual result.
- Except where the Company acts intentionally or with gross negligence, the Company is liable, to the extent permitted by applicable law, for loss arising from failures of external services beyond the Company’s control, communication failures, the condition of the user’s device, or choices made by the user.
Account Deletion
Users may request deletion of their account through the account-deletion procedure provided in the app. Details regarding account deletion and the processing of personal information are governed by the Privacy Policy and Account Deletion guidance. Deleting an account does not cancel an Apple App Store or Google Play subscription.
Governing Law and Disputes
These Terms are interpreted under the laws of the Republic of Korea. However, they do not limit rights under mandatory consumer-protection laws that apply in the user’s country or region of residence. Disputes will be handled by a court or authority having jurisdiction under applicable law.
